The Truckers' Best Friend ("TBF") Reward Program ("Program")
is operated by Fort Garry Industries Ltd. ("Fort Garry",
"our" or "we"). When you enrol in the Program as a Collector
of TBF Reward Points, we license you to collect points
on participating products and/or services provided by
Fort Garry.

Membership in the Program is free. Enrolment, membership and all
related benefits of the Program are offered at our sole
discretion. By enrolling in the Program or collecting
TBF points, you agree that you have read and understand
these Terms and Conditions and are bound by all of them,
as changed from time to time, and you consent to our collection
and use of your personal information in accordance with
our Privacy Commitment. Membership
is solely for the benefit of the applicant.
ELIGIBILTY.
To enroll, you must have a valid Canadian address and
be of legal age in the province in which you reside. This
Program is intended for Owner/Operators as defined by
Fort Garry.
POINTS.
The Program is based on a point system. Points awarded
on the Program have no cash value, and can therefore not
be exchanged for cash or used as a credit against any
account with Fort Garry. Points are not transferable and
cannot be combined with any other TBF account.
Points will not be available on wholesale or quote priced items.
This Program may not be combined with any other Fort Garry
Program including, but not limited to, the TRIM and Associate
Store Programs. At this time points are not available
on Trailers or any Truck Mounted Equipment.
COLLECTION OF POINTS.
To collect TBF points you must identify yourself as a
TBF cardholder and present your card at time of purchase.
Points may be collected at any participating Fort Garry
Store. (At this time points are not available for purchases
from CBS Parts or its' affiliates.) Your TBF account is
awarded one point for every Cdn. $1.00 in Net Purchases
charged to your TBF card during the operation of the Program.
(Special promotions may increase point allocation.) Credits
for returns or adjustments reflected on your TBF account
during the Program will reduce or cancel the points earned
by the amounts originally charged.
"Net purchases" are purchases of applicable goods and services
from Fort Garry excluding core charges, all taxes, and
service charges and less any credits, returns or adjustments
posted to your TBF account.
REDEMPTION OF POINTS.
Points may be redeemed for any of the merchandise awards
within the TBF Rewards Catalogue.
Where a TBF cardholder also has a Fort Garry account, points
will only be redeemed where the Fort Garry account is
current and in good standing.
Application for points redemption may be made either through the
Fort Garry web site, fax, mail or in-store.
All rewards are subject to availability. If an item is unavailable
exactly as shown, you may be sent a substitute of equal
or greater value.
We assume no responsibility for any loss, injury, death,
or expense relating to any reward, or for rewards
not turning out as you expected for whatever reason.
Defective Merchandise: Should the merchandise received be defective,
you may return it to any Fort Garry store within 15 days,
at your expense in the original packaging. Your item will
then be replaced or your points restored to your account.
COMMITMENT TO PRIVACY.
We are committed to protecting your privacy. Fort Garry
agrees not to provide others with or the use of specific
TBF cardholder information such as names, address, and
phone numbers. We may collect and use your personal information to:
- Administer the Program
- Invoice Program sponsors as required
- Communicate information and offers to TBF cardholders, Sponsors and Suppliers
- Understand and analyze TBF cardholders' responses, needs, and preferences
- Develop, enhance, market and/or provide products and services to meet those needs, and
- Enable TBF cardholders to participate in special promotions.

TAX.
You are responsible for any personal federal and/or provincial
income tax liability (including but not limited to income
tax) arising from the accrual or redemption of points
or the receipt of rewards merchandise from the program.
CHANGES TO PROGRAM.
We may reserve the right to change, at any time, the formats
or elements of merchandise offerings or the program without
prior notification to you.
CHANGES TO RULES.
We may change the rules periodically. You will be given
notice of each change. Use of your TBF card after notification
will mean acceptance of any and all rule changes.
TERMINATION.
In the event the TBF account is terminated because it
is not in good standing, your points will expire immediately.
Membership terminates on death and the points are forfeited;
points cannot be willed as part of an estate.
COMMUNICATIONS.
Fort Garry will send all notices to you by ordinary
mail, directed to the address provided. All TBF cardholders
are required to report any address changes to ensure that
you may be kept properly informed about TBF Program details
and information.
INTERPRETATION.
All questions and disputes regarding the Program and the
interpretation of these rules will be resolved by Fort Garry
and at our sole discretion.
GOVERNING LAW.
The laws of the Province of Manitoba will exclusively govern
these rules and the Program.
